1. SCOPE OF APPLICATION/CONTRACTUAL PARTNERS
1.1 The MYLE Festival 2024 (hereinafter referred to as “MYLE,” “Organizer,” or “Festival”) will take place at the designated festival grounds located on the premises of Motorworld Munich. The festival grounds include all areas of Motorworld Munich and adjacent venues that can only be accessed with a valid entry ticket (hereinafter referred to as “Ticket”) as well as the parking zones (collectively referred to as “Festival Grounds”).
1.2 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to buyers of a Ticket (hereinafter also referred to as “Visitors”) and the Organizer. If terms and conditions from the Organizer’s contractual partners apply and conflict with those of the Organizer, the Organizer’s GTC take precedence. By visiting the MYLE website and/or purchasing anything from MYLE, Visitors use our “Service” and agree to be bound by the following General Terms and Conditions (“General Terms and Conditions,” “Terms”), including any additional terms and policies referenced herein and/or available via hyperlink. These General Terms and Conditions apply to all users of the website, including but not limited to Visitors, vendors, customers, merchants, content contributors, and all MYLE Festival attendees.
Visitors must read these General Terms and Conditions carefully before accessing or using the MYLE website. By accessing or using any part of the website, Visitors agree to these General Terms and Conditions. If Visitors do not agree to all the terms and conditions of this agreement, they may not access the website or use any services. If these General Terms and Conditions are considered an offer, acceptance is expressly limited to these General Terms and Conditions.
By purchasing a ticket, Visitors enter into an event contract and acquire a right to attend the event.
1.3 In addition to obligations arising from these GTC, Visitors are also required to observe the additional rules for behavior in the various areas of MYLE, particularly on the festival grounds and in the parking zones.
1.4 Contractual relationships are established exclusively between the Organizer and the ticket purchaser through the acquisition of the ticket.
2. TERMS FOR ONLINE SHOP
2.1 By agreeing to these General Terms and Conditions, Visitors declare that they are of legal age in their country of residence or that they are of legal age in their country of residence and have granted us consent to allow their minor dependents to use this website.
2.2 Visitors must not use our products for illegal or unauthorized purposes, nor may they, through their use of the service, violate any laws in their jurisdiction (including but not limited to copyright laws).
2.3 Visitors must not transmit any worms, viruses, or other destructive code.
2.4 Violation or breach of any of these Terms will result in immediate termination of the Services.
2.5 We reserve the right to refuse service to anyone at any time for any reason.
2.6 Visitors acknowledge that their information (excluding credit card information) may be transmitted unencrypted and involve (a) transmissions over various networks and (b) changes to conform to and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during network transmission.
2.7 Visitors agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, the use of the Service, or access to the Service, or any contact on the website through which the Service is provided, without express written permission from MYLE.
2.8 MYLE is not responsible if the information provided on this site is not accurate, complete, or current. The material on this website is for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, complete, or timely sources of information. Any reliance on the material on this website is at your own risk.
2.9 This site may contain historical information. Historical information is not necessarily current and is provided for your reference only. We reserve the right to modify the contents of this website at any time, but we have no obligation to update any information on our website. You agree that it is your responsibility to monitor changes to our website.
3. CHANGES TO THE SERVICE AND PRICES
3.1 Prices for our products are subject to change without notice.
3.2 MYLE reserves the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.
4. PRODUCTS OR SERVICES
4.1 Certain products or services may only be available online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our return policy.
4.2 MYLE strives to display as accurately as possible the colors and images of our products shown in the shop. We cannot guarantee that your computer monitor's display of any color will be accurate.
4.3 MYLE does not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.
5. ACCURACY OF BILLING AND ACCOUNT INFORMATION
5.1 MYLE reserves the right to refuse any order placed with us. The Organiser may, at its sole discretion, limit or cancel purchase quantities per person, per household or per order. These restrictions may include orders placed from or under the same customer account or credit card and/or orders using the same billing and/or shipping address. If MYLE changes or cancels an order, we will attempt to notify the visitor by contacting the email and/or billing address/phone number provided at the time the order was placed. The Organiser reserves the right to restrict or prohibit orders that, in our sole discretion, appear to have been placed by dealers, resellers or distributors.
Visitors agree to provide current, complete and accurate purchase and account information for all purchases made in our shop. You further agree to promptly update your account and other information, including your email address and credit card numbers and expiry dates, so that MYLE can complete your transactions and contact you as needed.
6. ADDITIONAL TOOLS
6.1 The website may provide you with access to third-party tools over which MYLE neither monitors nor has any control or input.
Visitors acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. MYLE shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
6.2 Any use of optional tools offered through the website is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party provider(s).
6.3 In the future, MYLE may also offer new services and/or features through the website (including the release of new tools and resources). Such new features and/or services shall also be subject to these General Terms and Conditions.

7.1 Certain content, products, and services available via our Service may include materials from third parties.
7.2 Third-party links on this site may direct Visitors to third-party websites that are not affiliated with MYLE. MYLE is not responsible for examining or evaluating the content or accuracy and does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.
7.3 MYLE is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with third-party websites. Please review the third party's policies and practices carefully and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
8. USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS
8.1 If Visitors, at our request, send certain specific submissions (e.g., contest entries) or, without a request from us, send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence, (2) to pay compensation for any comments, or (3) to respond to any comments.
8.2 MYLE may monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates any party’s intellectual property or these General Terms and Conditions.
8.3 You agree that your comments will not violate any rights of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead MYLE or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. MYLE takes no responsibility and assumes no liability for any comments posted by you or any third party.

10. ERRORS, INACCURACIES, AND OMISSIONS

10.2 MYLE is under no obligation to update, amend, or clarify information in the service or on any associated website, including but not limited to pricing information, except as required by law. No specific update or refresh date applied to the service or any associated website should be taken to indicate that all information in the service or on any associated website has been modified or updated.
11. PROHIBITED USES
In addition to other prohibitions set forth in the General Terms and Conditions, you are prohibited from using the website or its content:
(a) for unlawful purposes;
(b) to solicit others to perform or participate in any unlawful acts;
(c) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances;
(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
(f) to submit false or misleading information;
(g) to upload or transmit viruses or any other type of malicious code that will or may affect the functionality or operation of the service or any associated website, other websites, or the Internet;
(h) to collect or track the personal information of others;
(i) for spamming, phishing, pharming, pretexting, spidering, crawling, or scraping;
(j) for any obscene or immoral purposes; or
(k) to interfere with or circumvent the security features of the service or any associated website, other websites, or the Internet.
We reserve the right to terminate your use of the service or any related website for violating any of the prohibited uses.
12. ARRIVAL
Arrival at the festival site and parking are at your own risk. For environmental reasons, we strongly encourage the use of public transportation. If you choose to use the fee-based parking spaces associated with the festival site, the following special parking terms and conditions apply.
13. ENTRY TO THE FESTIVAL SITE
13.1 Tickets are exchanged for festival wristbands, which must be worn at all times while on the festival grounds. Open or damaged wristbands lose their validity and must be replaced immediately at the ticket booth.
13.2 The organizer reserves the right to deny entry to the festival site for important reasons, including but not limited to:

Carrying prohibited items as outlined in Section 14.1;
-
Being visibly intoxicated;
-
Appearing to be under the influence of drugs;
-
Exhibiting homophobic, sexist, racist, or degrading behavior;
-
Violating youth protection regulations.
If entry is denied for any of these reasons, the ticket becomes invalid, and the ticket price will not be refunded.
13.3 Visitors found on the festival site without a valid wristband will be removed. No refund will be given.
13.4 The organizer may implement preventive measures, require cooperation, and enforce behavioral rules to meet health and safety requirements. Adherence to the hygiene concept and infection control regulations in place at the time of the event is mandatory. Failure to comply may result in a ban from the event. Despite all measures, the organizer cannot guarantee the complete exclusion of the risk of infection, including with SARS-CoV-2.
14. PROHIBITED ITEMS/ENTRY CONTROL
14.1 The following are prohibited on the festival grounds:

Drugs and intoxicants;
-
Containers made of fragile or splinterable material;
-
Mechanical or electric noise instruments;
-
Fireworks, rockets, sparklers, pyrotechnics;
-
Recording devices for commercial use without prior permission;
-
Weapons, including "protective weapons" under § 17a of the German Assembly Act;
-
Corrosive or staining substances and hazardous materials;
-
Racist, xenophobic, or radical propaganda materials;
-
Animals.
14.2 Security checks, including body and bag searches, will be conducted at entry points. Visitors agree to these checks and must follow the instructions of security personnel. Non-compliance may result in immediate expulsion from the event.
14.3 Prohibited items must be disposed of or stored outside the festival grounds. Items left in disposal bins cannot be retrieved. No refund will be given for tickets if entry is denied due to prohibited items.
15. HOUSE RULES / CODE OF CONDUCT / PHOTOGRAPHY AND FILMING
15.1 The organizer or its representatives enforce house rules. Visitors must follow the instructions of the festival staff. Specific rules for individual areas, such as parking or the main festival grounds, may apply and will be communicated appropriately.
15.2 Visitors are prohibited from:

Carrying prohibited items as outlined in Section 14.1.
-
Using physical violence against others, staff, or third parties.
-
Throwing objects at stages, staff, or other visitors.
-
Defacing or damaging property.
-
Conducting commercial activities, marketing, or advertising without prior written permission. Unauthorized advertising will be billed based on sponsorship rates, with additional claims for damages.

Accessing restricted areas or climbing structures such as stages or tents.
15.3 Photography and filming for personal use are permitted, provided third-party privacy rights are respected. Professional equipment or recording for commercial purposes requires prior approval. Violations will be prosecuted.
15.4 Photos and videos may be taken during the festival by the organizer or designated parties for reporting or promotional purposes. Visitors should anticipate the possibility of being filmed or photographed.
15.5 Violating the code of conduct may result in expulsion, a ban from the festival, or legal action. If expelled, tickets lose validity, and refunds are not issued. Visitors may be held liable for damages caused by their violations.
16. YOUTH PROTECTION
16.1 The festival adheres to youth protection laws.
16.2 Evening events, particularly those associated with the MYLE Music Circuit, are restricted to individuals aged 18 and over, even with a legal guardian present.
16.3 Age verification may be conducted at entry points by security personnel.
17. HEALTH RISKS DUE TO LOUD VOLUME
Visitors acknowledge the potential health risks, including hearing damage, associated with the high sound levels at the festival, particularly near stages. The organizer takes measures to minimize risks but strongly advises the use of earplugs and choosing stage proximity suited to individual comfort.
18. EVENT SCHEDULE / PROGRAM CHANGES
18.1 The organizer has no control over the content, duration, or quality of individual performances and accepts no liability in this regard.
18.2 Tickets grant access to various concerts and accompanying events. Changes to the program, cancellation of individual acts, or exhibitor absences do not entitle visitors to claims against the organizer, provided the overall festival character remains intact.
18.3 Program updates will be announced on the festival's official website and social media channels.
18.4 Not all areas of the festival are barrier-free due to structural limitations. No refunds will be issued for restricted access.
19. CANCELLATION, TERMINATION, OR MODIFICATION OF THE EVENT / FORCE MAJEURE
19.1 If the event is canceled, terminated, or modified due to circumstances beyond the organizer's control (force majeure), such as terrorist acts, threats, war, civil unrest, strikes, natural disasters, pandemics, or government orders related to such events, the provisions under Section 19.2 apply.
19.2 In the event of cancellation, termination, or modification as outlined in Section 19.1, both parties are released from their contractual obligations. Visitors may request refunds in accordance with statutory provisions. Any claims for damages or reimbursement of expenses are excluded.
19.3 If the festival is canceled due to COVID-19-related government orders or risks assessed by the organizer (e.g., health risks, travel restrictions, contractor cancellations), Section 19.2 applies accordingly.
19.4 Cancellations or changes will be communicated as early as possible by the organizer. During the festival, changes will be announced via screens or notices on-site. Visitors cannot claim compensation unless the organizer acts with gross negligence or intent. On-site instructions and notices are binding.
20. PARKING
20.1 The parking areas are managed by a subcontractor authorized by the organizer, exercising house rules on their behalf. Only vehicles approved for public roads may be parked. Parking is not monitored or safeguarded, and overnight stays in vehicles are prohibited.
20.2 Visitors can select a non-reserved parking space unless assigned one. Vehicles must be parked within marked spaces to ensure free access to adjacent spots. Non-compliance may result in vehicle relocation or removal at the visitor's expense. Damages caused by misuse of the parking area are the visitor's responsibility.
20.3 Parking staff manage access permissions but do not monitor vehicles.
20.4 Vehicles may be towed at the visitor's expense if:
a. Parking time exceeds the permitted duration without prior agreement.
b. The vehicle leaks fluids or poses safety risks.
c. The vehicle lacks proper registration or is seized by authorities.
d. The vehicle is parked outside designated spaces.
21. TEST DRIVE REGISTRATION, DATA SHARING, AND PROCESSING
1. MYLE's Role
MYLE acts as an intermediary for test drive arrangements between applicants and participating car brands. The test drive agreement is made directly between the applicant and the respective brand.
2. Liability
MYLE is not liable for claims or issues related to test drives. Any claims must be directed to the respective brand.
3. Participant Responsibilities
Participants must comply with the conditions set by the brand. MYLE is not responsible for ensuring compliance by either party.
4. Brand Contact Information
Details for inquiries or claims will be provided by the respective brand.
5. Consent for Data Sharing
By registering for a test drive, participants consent to their personal data being shared with the respective brand for scheduling and marketing purposes.
6. Withdrawal of Consent
Participants may revoke consent at any time. Upon withdrawal, data will no longer be used for marketing or shared further.
7. Data Protection
Data processing adheres to applicable laws. Details can be found in MYLE's privacy policy.
22. LIABILITY
22.1 The organizer is not responsible for lost, stolen, or damaged personal items.
22.2 The organizer's liability is limited to:
a. Full liability for intentional or grossly negligent acts by the organizer or its executives.
b. Liability for breaches of essential contractual obligations (limited to foreseeable damages).
c. No liability for auxiliary agents except in cases of gross negligence.
22.3 Exceptions to these limitations include damages to life, body, or health caused by the organizer, liability under the Product Liability Act, or if guarantees were explicitly given.
22.4 Statements by unauthorized personnel or on unofficial social media channels are not guaranteed by the organizer.
22.5 Service disruptions are not guaranteed to be error-free, uninterrupted, or timely. MYLE assumes no liability for issues arising from such disruptions.
23. CHANGES TO TERMS AND CONDITIONS
MYLE reserves the right to update these terms at its discretion. Updated versions will be posted on the festival's website. Continued use implies acceptance of the changes.
24. INDEMNIFICATION
Visitors agree to indemnify MYLE GmbH and its affiliates from claims arising from violations of these terms or third-party rights.
25. GOVERNING LAW AND SEVERABILITY
25.1 These terms are governed by German law.
25.2 Should any provision be invalid, the remaining terms remain effective under § 306 BGB.
